These Website Terms govern use of the CORUM website. They are not the complete agreement for purchasing, hiring, financing, transporting or servicing equipment. Separate written transaction documents govern those arrangements.
Nothing in these Website Terms excludes rights or remedies that cannot lawfully be excluded under Australian law, including any applicable Australian Consumer Law rights.
Material on this website is provided as general information about CORUM’s equipment, services and business. CORUM seeks to keep information current and accurate. You should confirm material information with CORUM before relying on it for a commercial decision.
Availability, configuration, pricing and commercial terms must be confirmed in writing before you rely on them for a purchase, hire or other transaction.
Listings may include details such as model, year, operating hours, weight, dimensions, power, condition, attachments, inclusions, service history, location and availability. Those details may be based on supplier information, available records, inspection notes and information provided for the listing.
For used equipment, condition and hours should be confirmed before purchase. A listing does not guarantee that equipment remains available. Final specifications and inclusions are confirmed in the written quotation or agreement.
Certification, inspection status, warranty support, condition and availability apply only where expressly stated for the relevant machine and confirmed in the applicable written documents.
Images may show the actual machine, a representative machine, optional equipment or indicative attachment configurations. Colours, attachments, specifications and appearance may differ from the equipment ultimately supplied.
If a visual detail is material to your decision, please ask CORUM to confirm it. This section does not excuse materially misleading representations.
These Website Terms do not give CORUM an unrestricted right to change a completed or accepted agreement.
Submitting a form, requesting availability, requesting a quote, making a phone call, viewing a listing or discussing finance does not, by itself, create a binding equipment sale, hire arrangement, finance agreement, warranty approval, delivery agreement or reservation.
A transaction becomes binding only under the applicable accepted written quotation, order, sale agreement, hire agreement or other written document.
Separate documents may include quotation terms, sale agreements, used-equipment schedules, hire agreements, deposit and payment terms, delivery or handover records, warranty schedules, condition reports and finance-provider documents.
Where a separate accepted transaction document is inconsistent with these Website Terms, the specific transaction document governs that transaction to the extent of the inconsistency.
Deposits, payment timing, ownership, delivery, risk and any Personal Property Securities Act arrangements are governed by the relevant written transaction documents. The website itself does not transfer title or create a security interest.
You should review the relevant quotation or agreement before making payment.
Warranty information on the website, including the page at /warranty, is a summary only. New equipment support and selected used equipment support are separate. Applicable eligibility, exclusions and terms are confirmed in writing.
Eligible new CORUM machines include two-stage limited Warranty cover: 24 months or 2,000 operating hours of new-machine coverage, followed by limited major-component coverage to a total of 48 months or 4,000 operating hours from the original delivery date, whichever occurs first. Full terms, exclusions, servicing requirements and eligibility apply.
Selected used machines may include limited commercial warranty support depending on age, hours, condition and supply arrangement. Full terms are confirmed before purchase.
Nothing in these Website Terms excludes rights or remedies that cannot lawfully be excluded. Australian Consumer Law rights may apply depending on the transaction and the customer. Website wording does not replace written warranty terms.
Equipment hire is subject to availability. Customer eligibility, intended use, location, transport and hire period must be confirmed with CORUM. A separate Hire Agreement applies. Rates and inclusions must be confirmed in writing.
Website hire information does not guarantee availability, Australia-wide service or replacement equipment.
Any finance references on the website are general information only. Finance is subject to application, eligibility, approval and the provider’s terms. CORUM does not guarantee approval, rates, repayments or availability.
CORUM only sends relevant information to a finance provider where you request finance assistance or provide authority. Finance-provider documents govern any finance arrangement.
Unless expressly stated otherwise in an applicable written arrangement, CORUM does not provide credit, make finance approval decisions or act as the customer’s finance adviser. Where requested or authorised, CORUM may introduce a customer to an independent finance provider. The provider is responsible for its own assessment, approval, rates, repayments and finance documents.
CORUM owns or licenses its website content, branding and design, unless otherwise stated. Komatsu, Bobcat and other third-party names, logos and trademarks belong to their respective owners.
References to third-party brands are used to identify relevant equipment, parts, compatibility or supply context. They do not imply affiliation, authorisation, endorsement or an Australian dealership unless expressly stated and verified.
External links and embedded or linked services may have separate terms and privacy practices. CORUM is not responsible for third-party content or practices, except to the extent Australian law does not allow responsibility to be excluded.
You must not use the website for unlawful or fraudulent activity, misrepresentation, malware distribution, security interference, attempts at unauthorised access, scraping or automated extraction that materially disrupts the website or misuses protected content, or copying protected content for commercial reuse without permission.
Ordinary browsing, legitimate indexing and lawful consumer activity are not prohibited by this section.
Nothing in these Website Terms excludes liability, rights or remedies that cannot lawfully be excluded, including liability for fraud, wilful misconduct, misleading or deceptive conduct where that liability cannot lawfully be excluded, or applicable consumer guarantees.
To the extent liability may lawfully be limited, CORUM is not liable for loss arising solely from reliance on website information that you could reasonably have confirmed with CORUM before acting, or from website downtime, interruption or technical error.
You remain responsible for independently confirming material equipment and commercial details before entering a transaction. CORUM does not guarantee uninterrupted or error-free website access.
Personal information submitted through or in connection with the website is handled as described in the Privacy Policy.
These Website Terms are governed by the laws of Victoria, Australia. The courts of Victoria have jurisdiction, subject to any applicable mandatory rights or jurisdiction rules.
CORUM may post revised Website Terms with an updated date. Changes govern future use of the website. Changes do not retrospectively rewrite a completed transaction governed by an accepted written agreement.
